Gateway Access and Usage – Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Dealbazaar (SMC-Private) Limited (“we,” “us,” or “our”). By accessing or using our platform, website, APIs, or any related services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using any part of the Dealbazaar platform — including submitting transactions, using our APIs, registering as a merchant, or browsing our website — you acknowledge and accept these Terms. If you do not agree, you must discontinue the use of our services.

2. Definitions

Platform: The digital system, APIs, and infrastructure operated by Dealbazaar for payment gateway and financial technology services.
User: Any individual or entity accessing the Dealbazaar platform.
Merchant: A registered business or individual authorized to use our platform and API services.
Customer: End users whose transactions are processed through the Dealbazaar system via merchants.
Services: All services offered by Dealbazaar, including payment processing, API access, dashboards, and related tools.

3. User Responsibilities

Users must provide accurate, complete, and updated information during registration and use.
Users must not use the platform for unlawful, fraudulent, or abusive activities.
Merchants must comply with all relevant laws, regulations, and financial guidelines in Pakistan.

4. Platform Responsibilities

Dealbazar will take reasonable measures to ensure platform functionality, uptime, and security.
We will support transaction routing, status updates, refunds, and service workflows as per our policies.

5. Limitation of Liability

To the maximum extent permitted by Pakistani law, Dealbazaar is not responsible for:

Merchant delivery failures or disputes between merchants and customers;
Failures of third-party services such as banks, payment partners, or mobile wallets;
Indirect, incidental, or consequential damages.

Our liability for any claim shall not exceed the disputed transaction amount or PKR 10,000, whichever is lower.

6. Termination of Access

Dealbazaar reserves the right to suspend or terminate access to any service, with or without notice, if a user or merchant violates these Terms or engages in activities that threaten platform integrity.

7. Force Majeure

Dealbazaar shall not be held liable for delays or service interruptions caused by events beyond our control, including natural disasters, internet outages, cyberattacks, system failures, government actions, or other unforeseen circumstances.

8. Cookies & Tracking Policy

Dealbazaar may use cookies and tracking technologies to enhance user experience and analyze platform performance.

Types of cookies used:

Essential Cookies: Necessary for system operation and security.
Performance Cookies: Improve efficiency and help us monitor performance.
Analytics Tools: We may use services like Google Analytics or Meta Pixel.

By using our services, you consent to our cookie and tracking practices.

9. API Usage Policy

This policy applies to all merchants and developers integrating Dealbazaar APIs.

Permitted Use

APIs may only be used for legitimate and approved business activities.

Fair Usage

Each API key has limits for TPS (Transactions Per Second) and daily quotas. Abuse or bypassing restrictions is prohibited.

Prohibited Activities

You may not use Dealbazaar APIs for:

Illegal financial activities, including money laundering or fraud;
Scraping, flooding, or unauthorized probing of the system;
Redirecting funds to accounts not approved during onboarding.

Security Obligations

Merchants must secure their API keys and immediately report any suspected breach.

Suspension / Termination

Dealbazaar may throttle, suspend, or permanently revoke API access for misuse, without prior notice.

Audit Rights

Dealbazaar reserves the right to review API logs and usage activities to ensure compliance and security.

10. Governing Law

These Terms are governed by the laws of Pakistan. Any dispute arising from these Terms shall fall under the exclusive jurisdiction of courts located in Pakistan.

11. Amendments

Dealbazaar may update these Terms at any time. Users will be notified through platform alerts or email. Continued use of our services constitutes acceptance of the revised Terms.
